ART Turbos Terms & Conditions of Sale

These Terms & Conditions ("Terms") apply to every order placed at artturbos.com. "ART Turbos," "we," "us," and "our" mean ART Turbos, 626 N Main St, Cottage Grove, WI 53527. "You" means the person placing the order. By clicking "Place Order," you confirm that you have read and agree to these Terms, along with our Privacy Policy, Shipping & Returns policy, and Core Policy.
1. Orders and Acceptance
Your order is an offer to buy. We accept it when we ship it or send you shipment confirmation. We may decline or cancel any order, in whole or in part, for reasons such as stock shortages, suspected fraud, or pricing or product errors. If we cancel an order you've already paid for, we will refund you in full.
2. Pricing and Payment
Prices are in U.S. dollars and may change without notice. Prices do not include shipping or applicable sales tax, which are calculated at checkout. Payment is charged when you place your order. By submitting payment, you confirm you are authorized to use the payment method. If we discover a pricing error, we may cancel the order or contact you to confirm the correct price.
3. Fitment and Part Selection
Turbochargers and related parts are application-specific. You are responsible for confirming that the part you order fits your engine, model year, and application. Please verify part numbers, engine codes, and specifications before purchasing. If you are unsure, contact us at customerservice@artturbos.com or 720-892-9546 before ordering. We are not responsible for returns, installation costs, or other expenses caused by ordering the wrong part, except where we made an error (see Section 6).
4. Core Charges and Core Returns
Remanufactured and rebuilt products may carry a core charge, shown at checkout or on the product page.
Your core must be returned within sixty (60) days of the shipping invoice date. If you need more time, contact us before the deadline and we may extend it.
The core must be returned in off-engine condition, exactly as removed from the vehicle or equipment, and must not be disassembled.
Cores must be packed in adequate, protective packaging. Standard cardboard boxes that are not rated for heavy items are not adequate.
A core that has been disassembled or partially assembled and then suffers shipping damage will receive a 50% deduction on the core refund.
We may reduce or deny the core refund if the core is not the same type as the one we shipped, is not rebuildable, or is returned after the deadline.
Core charges for cores that are not returned within the required period are non-refundable.
5. Shipping
We ship to most addresses worldwide, though some products cannot be shipped internationally. Shipping rates are shown at checkout and are often weight-based; weights are rounded up to the next full pound. We offer free shipping on qualifying orders over $99 continental U.S. only. Delivery dates are estimates only and not guaranteed. Risk of loss passes to you when we hand the package to the carrier. Please inspect your package on arrival and report visible damage to us within [5] days of delivery, keeping all packaging for the carrier's inspection. You are responsible for providing a correct shipping address. International customers are responsible for any customs duties, taxes, and import fees.
6. Returns and Refunds
New, unopened items in original packaging may be returned within 30 days of delivery for a full refund.
Our error (incorrect or defective item): we pay return shipping. Contact us for a prepaid label.
Other returns: the customer pays return shipping unless we agree otherwise.
To start a return, contact us with your order number and details. Do not ship anything back until we confirm instructions.
Refunds are issued to the original payment method after we receive and inspect the return. Please allow up to four weeks from the time you ship it, which covers transit, processing, and your bank's timing.
Not returnable (unless defective or sent in error): items that have been installed, used, or damaged; opened or modified items; special-order, custom, or balanced/calibrated products; and clearance items marked final sale. Original shipping charges are non-refundable unless the return is due to our error.
7. Warranty
ART Turbos remanufactured units are warranted against defects in materials and workmanship for 1 year / 100,000] months/miles from the date of delivery.
Warranty coverage does not apply to failures caused by:
Improper installation or incorrect fitment
Oil starvation, oil contamination, or use of incorrect oil
Foreign object damage, or ingestion of debris, dirt, or coolant
Unresolved underlying engine problems (e.g., clogged oil feed or drain lines, leaking injectors, failed EGR or DPF components, excessive crankcase pressure, or exhaust or intake restrictions)
Failure to follow the proper installation and pre-lubrication procedures
Racing, competition use, or modification of the part
Normal wear and tear, accident, abuse, or neglect
Warranty remedies are limited to repair, replacement, or refund of the product price, at our option. Warranty does not cover labor, towing, diagnostic fees, or other installation-related costs.
8. Installation and Use; Emissions Compliance
Turbochargers and related components should be installed by a qualified technician in accordance with the manufacturer's procedures. You are responsible for ensuring that installation, modification, and use of any product complies with all applicable federal, state, and local laws, including emissions regulations. Some products may not be legal for use on pollution-controlled vehicles or on public roads, including in California and other states that follow CARB standards, and may be sold for off-road or competition use only. You are solely responsible for determining whether a product is legal for your intended use. We do not authorize or encourage the removal or defeat of emissions control equipment.
9. Services
If you purchase services such as turbo rebuilding, VSR balancing, or actuator calibration, additional terms may apply. We will confirm the scope, price, and turnaround with you in advance.
10. Disclaimer of Warranties
EXCEPT FOR THE EXPRESS WARRANTY IN SECTION 7 (IF ANY), PRODUCTS AND SERVICES ARE PROVIDED "AS IS." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some jurisdictions do not allow certain disclaimers, so these may not apply to you.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ART TURBOS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DOWNTIME, LOSS OF USE, TOWING, LABOR, OR DAMAGE TO ENGINES OR EQUIPMENT, ARISING FROM YOUR PURCHASE OR USE OF OUR PRODUCTS OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE AT ISSUE. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Product Information
We try to keep descriptions, images, specifications, and availability accurate, but errors can occur. Images are for illustration, and OEM and cross-reference part numbers are provided for identification only. Brand names (such as Garrett, Holset, BorgWarner, and Melett) belong to their respective owners and are used for reference only [confirm authorized-dealer status wording].
13. Privacy
We use your information to process orders, provide support, and as described in our Privacy Policy.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in [Dane County], Wisconsin, and you consent to that jurisdiction. Before filing a claim, please contact us so we can try to resolve the issue informally.
15. Changes and General
We may update these Terms at any time. The version in effect when you place your order applies to that order. If any provision is found unenforceable, the rest remain in effect. These Terms, together with the policies referenced above, are the entire agreement between you and ART Turbos for your order.
